Terms of Service and Commercial Operating Agreement

1. Commercial Scope and Entity Governance

These Terms of Service govern the purchase, access, and operational deployment of the Raw Frontier Autonomous AI Operator software suite, architecture blueprints, pre-configured department brain cartridges, cloud containers, and associated services delivered through rawfrontier.com and unthrottledai.com. Raw Frontier is a commercial technology brand owned and operated by Advertising and Sales LLC, a wholly owned operational subsidiary of Stonikas Holdings LLC.

By purchasing a license, deploying a container, or connecting an API key to our software, you enter into a binding commercial agreement with Advertising and Sales LLC. If you access or use this software on behalf of a corporation, partnership, or agency, you represent and warrant that you hold full legal authority to bind that entity to these terms.

2. Autonomous AI Execution and System Liability Disclaimers

Large language models and autonomous software agents operate non-deterministically. While our System-1 verification gates and deterministic Python code nodes enforce strict output checks, language models may produce unexpected interpretations, factual hallucinations, unhandled exceptions, or unintended tool parameters.

Under no circumstances will Advertising and Sales LLC, Stonikas Holdings LLC, or our officers, employees, and software architects be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from autonomous agent execution. This limitation of liability covers, without limitation:

• Third-party API token billing charges, rate limit surcharges, or unexpected compute spend incurred on your connected provider accounts.
• Live advertising budget modifications, campaign pauses, bid changes, or account policy enforcement actions taken by advertising platforms such as Meta, Google, or TikTok.
• Outbound communications, messages, or emails dispatched autonomously by agents connected to your communications infrastructure.
• Database modifications, deletions, file overwrites, or code deployments executed by tools within your cloud workspace.
• Business interruptions, lost commercial revenue, regulatory penalties, or customer disputes arising from agent operational outputs.

You maintain sole legal and operational responsibility for establishing human oversight, configuring budget stop-loss thresholds, setting automated circuit breakers, and reviewing high-consequence agent actions before deployment into live environments.

3. 365-Day Unconditional Money-Back Guarantee

You have a full 365 calendar days from the date of purchase to deploy the blueprints, run the interactive simulators, test the four department cartridges, and evaluate the architecture in your business. If you decide for any reason that the system does not deliver measurable operational leverage, you may request a complete refund of all front-end digital kit fees.

To claim a refund, email support@rawfrontier.com or support@advertisingandsales.com within 365 days of purchase with your checkout email address and transaction confirmation. Our finance team will issue a 100% refund back to your original payment card within one business day. There are no restocking fees, no return shipping steps, and no procedural hurdles.

4. Dedicated Cloud Hosting and Continuity Subscriptions

The $97.00 setup fee covers initial container orchestration, security hardening, and database configuration. The $197.00 monthly subscription covers dedicated cloud computing resources, persistent SQLite state storage, network bandwidth, system updates, and automated health monitoring.

Cloud container subscriptions may be cancelled at any time through our self-service customer billing portal or by emailing support. Cancellations take effect at the conclusion of the current thirty-day billing period, with no cancellation penalties. Because dedicated server compute capacity is allocated directly with cloud infrastructure providers upon renewal, monthly hosting fees are non-refundable once the thirty-day billing cycle begins. Initial setup fees remain covered under our satisfaction guarantee.

5. Private Cloud Sovereignty and Customer Data Privacy

Advertising and Sales LLC adheres to an absolute data sovereignty standard. Your company instructions, customer lists, financial ledgers, proprietary prompts, and API keys remain your exclusive property.

Our software runs inside your private, isolated container context. We do not aggregate your proprietary data, we do not inspect your operational transcripts, and we never train public artificial intelligence models on your company data. Third-party model API calls travel directly between your container and your selected model providers under your commercial API agreements.

6. Commercial License and Intellectual Property Rights

Upon completed payment, Advertising and Sales LLC grants you a worldwide, non-exclusive, non-transferable commercial license to use, adapt, and run the Raw Frontier software architecture, department cartridges, and workflow scripts for your internal business operations and for managing campaigns on behalf of direct agency clients.

You may not redistribute, resell, sub-license, publicly publish, or repackage the underlying source blueprints, system prompts, or cartridge files as a competing digital training course, information product, or standalone software template bundle. All proprietary title, copyrights, and intellectual property rights in the underlying framework remain with Advertising and Sales LLC and Stonikas Holdings LLC.

7. Maximum Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Advertising and Sales LLC, Stonikas Holdings LLC, or our suppliers and distributors be liable for any special, incidental, indirect, punitive, or consequential damages whatsoever, including damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss.

In all events, the total aggregate liability of Advertising and Sales LLC arising out of or related to this agreement, regardless of the legal theory asserted, will be strictly limited to the actual amount paid by you to Advertising and Sales LLC for the specific product or service giving rise to the claim during the twelve months preceding the event.

8. Governing Law, Corporate Jurisdiction, and Dispute Resolution

This agreement is governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these terms will be settled exclusively through binding commercial arbitration administered by the American Arbitration Association in Sheridan County, Wyoming. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Both parties agree that any dispute resolution proceedings will be conducted solely on an individual basis and not in a class, consolidated, or representative action.
